Prince Harry and Meghan Markle may never return to the UK – and it has nothing to do with their fallout from the royal family.

The Sussexes stepped down from royal life in 2020 and moved to California, where they still live with their two children. They have only returned to Britain a handful of times since, and as such, Archie and Lilibet have rarely been seen by the royal family.

And that seems unlikely to change any time soon. Harry reportedly fears bringing his two young children to the UK amid his ongoing legal concerns. The Duke is continuing to fight for taxpayer-funding security when he does visit the UK, despite no longer being a working royal.

GB News’s Royal Correspondent Cameron Walker said: “Harry’s case is he does not feel safe. He doesn’t feel his family is safe when they’re in the UK because they do not have police protection officers with the Metropolitan Police with him.

“So perhaps that is the main reason why Prince Harry isn’t bringing Meghan and Archie and Lilibet over to the UK because he can’t guarantee, he would say he can’t guarantee their safety.” It was ruled by the Executive Committee for the Protection of Royalty and Public Figures (Ravec) in February 2020 that Harry should receive a different level of security from the rest of the Royal Family in light of his decision to step down as a working royal and move to the US.

High Court judge Sir Peter Lane ruled that Ravec’s decision was “not irrational” and would stand. But last month it was revealed that Harry could appeal the ruling, according to an order from Lord Justice Bean dated May 23 2024.

In his ruling, Sir Peter argued that lawyers representing the Duke of Sussex had made “an inappropriate, formalist interpretation of the Ravec process” during the High Court case. He added: “The ‘bespoke’ process devised for the claimant in the decision of February 28 2020 was, and is, legally sound.”

The Home Office delegates responsibility for security arrangements of the Royal Family to Ravec, who also handle security for other important overseas guests. Following Sir Peter’s decision, a spokesperson for Harry said: 

“The Duke is not asking for preferential treatment, but for a fair and lawful application of Ravec’s own rules, ensuring that he receives the same consideration as others in accordance with Ravec’s own written policy.

“In February 2020, Ravec failed to apply its written policy to the Duke of Sussex and excluded him from a particular risk analysis. The Duke’s case is that the so-called ‘bespoke process’ that applies to him is no substitute for that risk analysis. The Duke of Sussex hopes he will obtain justice from the Court of Appeal, and makes no further comment while the case is ongoing.”
